Agreement to these terms

These Terms and Conditions (“Terms”) are a legally binding agreement between you and USA Books Publishing (“USA Books Publishing,” “we,” “us,” or “our”). By accessing this website, submitting a form, or requesting services, you agree to these Terms and to our Privacy Policy.

If you do not agree, do not use the site or send us a manuscript. If you are accepting these Terms on behalf of a company or other person, you confirm that you have authority to bind them.

Who we are

USA Books Publishing provides professional publishing services for authors, including writing support, editing, design, formatting, audiobook production, translation, and distribution setup. We are a services company. We are not a traditional publishing house that acquires copyright in exchange for royalties, and we are not a retailer.

Eligibility

You must be at least 18 years old (or the age of majority in your place of residence) to use this website and to enter a publishing-services agreement. If you are engaging us for a children’s book, you are the adult author, illustrator, or rights holder — not the child reader.

You confirm that the contact details you submit are accurate and that you will keep them current while we are in communication.

Website use

You may browse the site for lawful, personal, or internal business purposes. You agree not to:

  • Copy, scrape, or republish site content, pricing, or creative assets without our written permission
  • Interfere with the site, overload servers, or attempt to gain unauthorized access
  • Submit false, automated, or spam inquiries
  • Upload malware or content that is unlawful
  • Misrepresent your identity or affiliation

We may change, suspend, or discontinue any part of the website at any time. Features described online may be updated as our services evolve.

Inquiries are not a contract

Visiting the site, clicking Get Started, or sending a contact form is a request for information. It does not create a publishing contract, reserve a production slot, or obligate either party to proceed.

Paid work begins only after we issue a written scope (email or agreement is enough) that states the services, fees, and payment terms, and you accept that scope. Until then, either party may decline to continue.

Quotes and packages

Prices, comparisons, and package names on the website are starting figures and illustrations. Final fees depend on word count, genre, illustration, translation, audio, complexity, and schedule. A quote is valid for the period stated in it, or 14 days if no period is stated.

We may recommend a different package after we review the manuscript. We may decline a project that is not a fit for our capacity, expertise, or content standards. Add-ons requested after kickoff may be billed separately.

Author rights

Unless a separate written agreement says otherwise, you retain copyright and other intellectual-property rights in your manuscript, characters, and original artwork that you supply. We do not take your copyright, sequel rights, or a share of retail royalties in exchange for production services.

You represent that you own or have licensed all material you send us, including quoted text, images, fonts you supply, and third-party contributions, and that publication will not infringe anyone else’s rights or violate any confidentiality duty.

License to perform services

You grant us a limited, non-exclusive license to copy, edit, design, format, convert, store, and transmit your materials solely to perform the services you request and to keep archival copies as described in our Privacy Policy.

Original cover art, layout files, and other work product we create for your project are licensed to you for use in connection with that book once invoices for those services are paid in full. We retain the right to display non-confidential covers or titles in our portfolio unless you ask us in writing not to.

Content standards

We may refuse, pause, or terminate work that we reasonably believe is unlawful, defamatory, infringing, fraudulent, or that promotes illegal activity. We may also decline material that our printers, retailers, or payment partners will not accept.

Editorial suggestions are professional opinions, not legal, medical, or financial advice. You remain responsible for the accuracy of facts, permissions, and any claims made in the book.

Manuscripts and revisions

You are responsible for providing a complete, readable file (typically .doc or .docx) and for responding to queries in a timely way. Round limits for editing, cover concepts, and proofs will be stated in your scope. Extra rounds may be quoted.

You should keep your own backups. We take care with files in our possession, but we are not a long-term archive unless a signed agreement says otherwise.

Timelines

Dates we share are estimates. A typical complete manuscript on a standard package is often retail-ready in about 8–12 weeks, but illustration, developmental editing, translation, ghostwriting, author delays, and third-party review can extend that. We confirm a schedule after we see the file and you approve the scope.

We are not liable for delays caused by you, by retailers, by printers, or by events outside our reasonable control.

Fees and payment

Fees are due according to the invoice or payment schedule in your scope. Work may pause if an installment is late. Unless stated otherwise, prices are in United States dollars and exclude retailer, printer, and advertising costs that those platforms charge separately.

You authorize us to collect amounts you approve through the payment method you provide to our processor. Chargebacks initiated without first contacting us may result in suspension of files and accounts until resolved.

Refunds

Where we advertise a 30-day money-back guarantee, the conditions in that offer and in your written scope control. Custom work already delivered (for example completed editing, illustration, or narration) may be non-refundable to the extent of costs incurred.

If no guarantee applies, fees for services already performed are not refundable. Unused prepaid work may be credited at our discretion. Retailer listing fees, print proofs, and ads you approved are generally not refundable once spent.

ISBN, files, and distribution

Unless your agreement says otherwise, you remain the publisher of record. We may assist with ISBN setup, metadata, and files for print, ebook, and audio. Retailer accounts, tax information, and bank details for royalties are your responsibility unless we expressly manage a channel for you in writing.

Print quality, shipping times, and catalog visibility depend on printers and stores. We do not control their systems, policies, or ranking algorithms.

Retailers and third parties

Amazon, Ingram, Apple, Google, and similar platforms are independent. Their terms, content rules, and fees apply to you. We are not those companies’ agents. If a retailer rejects a title, we will tell you what we know and what can reasonably be changed; we cannot guarantee acceptance.

No earnings promise

Publishing a book does not guarantee sales, reviews, rankings, awards, media coverage, or a return on your investment. Examples, testimonials, and case studies are illustrative, not typical results, and they are not a forecast of your book’s performance.

Marketing services

If you purchase marketing support, we will perform the tasks in your scope (for example metadata, campaign setup, or creative). Marketing is not a promise of bestseller status, advertising approval, or a minimum number of readers. Ad platforms may reject creatives or change costs without notice.

Our intellectual property

The website design, logo, copy, graphics, package names, and other materials we publish (other than your manuscript) are owned by USA Books Publishing or our licensors. You may not use our marks in a way that suggests we published, endorsed, or guaranteed your book unless we agree in writing.

Testimonials and feedback

If you send a review or allow us to use your name, likeness, or cover, you grant us a non-exclusive right to use that material to describe our services. You may withdraw permission for future marketing use by emailing us; we are not required to recall printed or already distributed materials.

Disclaimers

The website and any information on it are provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that quotes on the site match a future signed agreement.

Limitation of liability

To the fullest extent allowed by law, USA Books Publishing and its officers, employees, and vendors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or lost goodwill, arising from use of the website or from a publishing project.

Our total liability for website use is limited to one hundred U.S. dollars (US $100). Liability for a paid publishing project is limited to the fees you actually paid us for the specific service giving rise to the claim during the three months before the claim, except where a signed agreement sets a different cap. Some states do not allow certain limitations; in those places, our liability is limited to the maximum permitted.

Indemnity

You will defend and indemnify USA Books Publishing against claims, damages, and reasonable legal fees arising from your content, your breach of these Terms, or your infringement of someone else’s rights, except to the extent caused by our willful misconduct.

Suspension and termination

We may suspend access to the website or stop work if you breach these Terms, fail to pay, or submit prohibited content. You may stop using the site at any time. Provisions that by their nature should survive (including rights, payment already earned, disclaimers, liability limits, and indemnity) remain in effect.

Governing law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-law rules, except that consumers in some jurisdictions may have mandatory local protections that we do not override.

Courts located in the United States have exclusive jurisdiction over disputes arising from the website, unless applicable consumer law requires otherwise. You and we waive class actions to the extent a waiver is enforceable. Nothing here limits a request for injunctive relief to protect intellectual property.

Changes

We may update these Terms when our services or the law change. The “Last updated” date will change. Material updates will be posted on this page. Continued use of the website after an update means you accept the revised Terms. A signed project agreement controls over these website Terms if the two conflict for that project.

If any part of these Terms is held unenforceable, the rest remains in effect. These Terms, together with the Privacy Policy and any signed scope of work, are the entire agreement for website use and, except as a signed agreement provides otherwise, for services requested through this site.
